C.R. Bard reportedly has paid $3.6 million to a woman injured by the company’s dangerous transvaginal mesh product. The vaginal mesh lawsuit was the first case to be tried against the medical device maker.
The jury in the case awarded the injured plaintiff $5.5 million, but the court reduced the verdict to $3.6 million. After losing its appeal from the $3.6 million verdict, the company had no choice but to pay that amount to the woman harmed by Bard’s defective medical product.
Transvaginal mesh manufacturers marketed their products to treat urinary incontinence and pelvic organ prolapse. But in thousands of woman, the devices have caused severe infections, vaginal scarring, painful intercourse and erosion of the urinary tract or vaginal wall. In many cases, painful corrective surgery is required to remove the medical device.
A few months after the jury awarded $5.5 million in the first TVM lawsuit against Bard, the company consented to settle 3,000 vaginal mesh lawsuits for more than $200 million. But that number represents only a fifth of cases now filed against Bard. More than 21,000 cases remain pending against the medical device manufacturer.
In West Virginia, 12,000 cases against Bard are pending before Judge Joseph Goodwin of the U.S. District Court for the southern federal district of the state. Judge Goodwin has strongly urged Bard to settle the cases pending in his court. Late last year, the company settled an additional 500 vaginal mesh lawsuits for $21 million.
But so far, Bard has refused to enter into a global settlement to resolve all the claims against it. Instead it has tried a variety of legal maneuvers to thwart plaintiffs’ TVM claims. That approach has not, however, proven successful.
