The family of a Boston letter carrier, who was exposed to asbestos in high school, is awarded $6.8M in a Massachusetts mesothelioma trial – Waters Kraus Paul & Siegel and Thornton Law Firm tried the case on behalf of plaintiffs.
A Boston jury has handed down a verdict of $6.8 million dollars to the family of a local U.S. postal worker against New England Insulation (NEI). Timothy Ross, who worked as a part-time insulator when he was in middle and high school and for several years as a young man, was exposed to asbestos dust while repairing and replacing asbestos insulation on boilers, hot water tanks, and pipes in the Boston area. As a result, Mr. Ross was diagnosed with the asbestos-related cancer, mesothelioma, in late 2012 and died from his disease nine months later. The case is Civil Action No. 13-5580; Amy Ross Individually and as Personal Representative of the Estate of Timothy J. Ross v. A.O. Smith Corporation, et al; Middlesex County Superior Court, Common Wealth of Massachusetts.
This is the second asbestos case in a week that Waters Kraus Paul & Siegel and Thornton Law Firm have taken to verdict in Boston. Just the week before, their clients, a power plant worker and his wife, were awarded $7.55 million, also against NEI.
Lead trial attorney and Waters Kraus Paul & Siegel partner, Peter Kraus, commented on the outcome saying that, “this verdict, right on the heels of the Sylvestre verdict, demonstrates that team work and a strong case with clear exposure and liability evidence can extend the scope of responsibility to all sellers, who knowingly provide harmful products to unsuspecting consumers.”
Mr. Ross began experiencing breathing difficulty in December 2012 and was diagnosed with mesothelioma a week before Christmas. He underwent surgery and chemotherapy to treat his mesothelioma, but succumbed to the disease only nine months later. He leaves behind his wife Amy Ross, their two daughters, and two grandchildren.
The Ross family is represented by Waters Kraus Paul & Siegel of Dallas and co-counsel the Thornton Law Firm of Boston.
